2. Petitioner apprehends arrest in a case registered for the offence punishable under sections 376, 313 , 323 and 34 of IPC and section 3⁄4 of Dowry Prohibition Act.
3. As per the prosecution case, this petitioner solemnized marriage with the informant on 10.02.2023. After the marriage , this petitioner and her in-laws started
Patna High Court CR. MISC. No.67544 of 2023(2) dt.19-10-2023 2/3 harassing and torturing her for demand of dowry but due to non-fulfillment of demand of dowry, all the accused persons ousted her from her matrimonial house.
4. Learned counsel for the petitioner submits that petitioner happens to be husband of the informant and has never demanded any dowry from her. In fact, being fed up with the informant this petitioner filed divorce petition against her on 03. 04.2023 bearing divorce case No. 85 of 2023 and after coming to know about this aforesaid case , in retaliation this false and concocted case has been lodged by the informant. Petitioner claims clean antecedent.
5. Learned counsel for the State opposes the bail petition of the petitioner.
6. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned S. D. J . M., Sadar Sitamarhi in connection with Bela P.S. case No. 112 of 2023 , subject to the conditions laid down under
