Petitioner apprehends his arrest in a case under sections 304B/34 IPC on the ground that he along with his family members killed informant's daughter due to non fulfillment of dowry.

The petitioner submits that informant's daughter herself committed suicide by putting herself on fire, as he (petitioner) refused to take her to Delhi due to poor income. Further, no eye witness has supported the prosecution case and after the occurrence the victim was immediately taken to the DMCH and then to the PMCH but she died on way to the PMCH.

Prayer for bail of petitioner in Baheri Police station Case No. 29 of 2013 dated 26.1.2013 is refused and is directed

Patna High Court Cr.Misc. No.2135 of 2015 (5) dt.03-07-2015 2/2 to surrender and seek regular bail before the Chief Judicial Magistrate, Darbhanga, which would be disposed of also taking into consideration that the petitioner had taken the victim to DMCH and then to PMCH for treatment but she died on way to the PMCH.
