JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 21-01-2015 Heard learned counsel for the petitioners and learned counsel representing the State.
The petitioners, apprehending their arrest in connection with Mehus P.S. Case No. 24 of 2013 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code, seek the privilege of pre-arrest bail.
At the very outset, it has been submitted that in this case, the police after completing investigation, submitted charge sheet against these petitioners under Sections 309 and 201/34 of the Indian Penal Code and accordingly they have been granted bail by
Patna High Court Cr.Misc. No.30568 of 2014 (2) dt.21-01-2015 the police.
As submitted by the petitioners, they are on police bail and as such, the petitioners should surrender in the court below and seek regular bail and in that case if, they have not misused the privilege of police bail, then they shall be enlarged on bail, on the same day.
Accordingly, this Criminal Miscellaneous is hereby disposed of.
