JUSTICE DINESH KUMAR SINGH ORAL ORDER 16-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in jail since 20.08.2014 in a case registered for the offences punishable under Sections 342, 456, 504, 365 and 366A/34 of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant.

In 164 Cr. P.C. statement, the victim got her age recorded as 19 years when the court also assessed as such where she stated that she of her own went to Patna and the petitioner did not kidnap her.

Considering the statement of victim girl, let the above named petitioner, be released on bail, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in

Patna High Court Cr.Misc. No.1846 of 2015 (2) dt.16-01-2015 2/2 connection with Mallaypur P.S. Case No. 35 of 2013. Considering the serious criminal antecedent of the petitioner, learned court below will positively cancel the bail bonds of the petitioner if he gets involved in some serious nature of offence or defaults for two consecutive occasions.
