JUSTICE SUDHIR SINGH ORAL ORDER 14-02-2017 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is apprehending his arrest in connection with Bihar P.S. Case No. 466 of 2013 for the offences instituted under Sections 147, 148, 149, 353, 307, 341, 323, 295, 295(A) and 153(A) of the IPC.

The prosecution story, in brief, is that the petitioner alongwith other known and unknown accused persons numbering 500-600 were making communal slogan and obstructed discharging official duty by the police personnel and further pelted stone on the members of another community.

It has been submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case. There is no allegation of tampering with the witnesses alleged against the

Patna High Court Cr.Misc. No.7281 of 2017 (2) dt.14-02-2017 2/2 petitioner. There is general and omnibus allegation has been made against the petitioner. No specific overt act has been alleged against him. The other co-accused have been granted anticipatory bail by another co-ordinate Bench of this Court vide Cr. Misc. No. 874/2017.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Bihar P.S. Case No. 466/2013 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Nalanda at Biharsharif, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
