1. Heard learned counsel for the petitioner and the learned A.P.P. for the State.

2. The petitioner apprehends his arrest in connection with Mahua P.S. Case No. 576 of 2022 registered under Section 272/273 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise Act.

3. Learned counsel appearing on behalf of the petitioner submits that similarly situated co-accused namely, Nilesh @ Lalu has already been allowed bail by a Co-ordinate Bench of this Court vide Cr. Misc. No. 63486 of 2022 on 02.12.2022, as contained in Annexure-2 to the bail application.

4. Having considered the facts and circumstances of the case, let the above named petitioner be released on bail, in

No.63354 of 2023(2) dt.16-10-2023 2/2 the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Exclusive Special Excise Court No. II-cum-Additional District and Sessions Judge, Vaishali at Hajipur in connection with Mahua P.S. Case No 576 of 2022, subject to the condition as laid down under Section 438(2) of the Cr. P.C.
