In this case, the petitioner is seeking regular bail in connection with Sheikhopur Sarai P.S. Case No. 48 of 2022, registered for the offences punishable under Sections 406, 419,
Patna High Court CR. MISC. No.68927 of 2022(4) dt.20-04-2023 2/3 420, 467, 468, 471, 120B/34 of the IPC.
As per allegation, in Cr. Misc. No. 68927 of 2022, the police personnel got information that some miscreants, engaged in cyber crime, in the name of lucky draw and to provide loans as well as the on the pretext of providing job, used to commit crime. The police party raided the house of Bipin Kumar. He was arrested and mobile phones, sim card, passbook of different persons, ID cards, ATM cards, Cheque, etc. were recovered from his possession. He disclosed that it was the petitioner and one Ankit Kumar, who used to supply mobile data to him. In Cr. Misc. No. 69729 of 2022, the police got information that in the house of one Kishori master, some miscreants were engaged in committing cyber crime by alluring the innocent persons to provide them gas connection. The police party raided the place of occurrence.
Co-accused Niranjan Kumar Patel @ Raju, Chintu Kumar, Rohit Kumar, Roshan Kumar and Rishu Kumar were arrested. A number of articles used in cyber crime were recovered from them. They apprised the police party that they extort money from the innocent persons by deception and at the assurance to provide them bank loan, gas cylinder, etc. They have also apprised the police party that data base, mobile, SIM, aadhar card, etc.
Patna High Court CR. MISC. No.68927 of 2022(4) dt.20-04-2023 3/3 them by the petitioner. On their disclosure, the house of the petitioner was raided, but the petitioner became successful in fleeing away. From the house of petitioner, some ATM cards and aadhar cards of 15 states were recovered.
The learned counsel for the petitioner has submitted that Bipin Kumar, from whose house, those articles were recovered has been granted bail by the co-ordinate Bench of this Court. He has submitted further that except confessional statement, there is nothing against the petitioner. On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that from the house of the petitioner, incriminating articles were recovered including the aadhar cards of 15 states. He has submitted further that the petitioner is involved in seven cases of similar nature, whereas in paragraph no. 3, only five cases have been disclosed. In my view, the petitioner does not deserve the privileges of bail, which is hereby rejected. (Nawneet Kumar Pandey, J) Kundan/Nirmal U T
