The petitioner apprehends his arrest in connection with Buxar (Town) P.S. Case No. 326 of 2016 registered under Sections 420, 457, 468, 471, 472/34 of the Indian Penal Code. The accusation is that one Kavita Devi, wife of Ram Lal Singh got executed the sale deed in respect of 0.25 decimal land of the informant Bir Bahadur Rai, on which the petitioner Ram Awadhesh Singh put his signature as a witness. Learned counsel appearing on behalf of the petitioner submits that in fact one Rajesh Rai along with his brother-in-law informant executed the sale deed in favour of Kavita Devi and on the instructions of Rajesh Rai, petitioner
Patna High Court Cr.Misc. No.6381 of 2017 (3) dt.24-04-2017 identified them and with ulterior motive the informant has lodged the present case. Moreover, the petitioner is not the beneficiary of the sale deed rather he put his signature as a witness on the sale deed.
Having regard to the facts and circumstances of the case, let the petitioner, namely, Ram Awadhesh Singh be released on bail, in the event of his arrest or surrender before the learned court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Buxar in connection with Buxar (Town) P.S. Case No. 326 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
