2. The petitioner apprehends his arrest in a case registered for the offence under Sections 406, 420 of the Indian Penal Code.

3. It is submitted on behalf of petitioner that petitioner is ready to give amount of Rs. 2,00,000/- to the informant, which he received through cheque from the informant, bearing cheque no. 248646. The rest of the alleged amount is disputed by the petitioner.

4. However, learned counsel for the informant submits that informant paid altogether Rs. 11,00,000/- (Rupees eleven lacs) to the petitioner on different dates.

5. Considering the fact that petitioner is ready to refund Rs. 2,00,000/- to the informant, which he received through cheque, in the event of arrest/surrender within a period of six weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Motihari, East Champaran in connection with Town P.S. Case No. 519 of 2021, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure with further condition that petitioner shall refund Rs. 2,00,000/- through bank draft to the informant at the time of furnishing bail-bond.
