====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-12-2025 Heard learned counsel appearing on behalf of the petitioner and learned A.P.P. appearing on behalf of the State.

2. The petitioner apprehends his arrest in a case registered for offences punishable under Sections 364, 365, 386, 302, 201, 120B, and 34 of the Indian Penal Code.

3. As per the prosecution case, the informant, namely Sabana Praveen, alleged that on 18.08.2020, while she along with her son was going to Station Chowk via Kamalnath Nagar, in the meantime, all the accused persons named in the F.I.R., along with 5-6 unknown persons, surrounded them and assaulted the son of the informant and then kidnapped him. When the informant tried to save her son, they pushed her and fled away with her son. It is further alleged that on 19.08.2020

Patna High Court CR. MISC. No.65555 of 2025(2) dt.05-12-2025 2/3 at about 1:30 AM, the informant found the dead body of her son near Mirja Tola. It is also alleged that prior to the alleged occurrence, the accused persons had demanded rangdari from the son of the informant, and upon his refusal, they committed his murder.

4. Learned counsel for the petitioner submits that the petitioner is not named in the F.I.R. The name of the petitioner surfaced during the course of investigation on the basis of the confessional statement of co-accused Sukku @ Shukku @ Anand Kumar Gupta, who was carrying identical allegations and has already been granted anticipatory bail by this Court vide order dated 25.07.2025 passed in Cr. Misc. No. 12468 of 2025.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of anticipatory bail to the petitioner.

6. Considering the aforesaid facts and circumstances, the prayer for grant of anticipatory bail to the petitioner is allowed.

7. Accordingly, in the event of arrest or surrender within a period of eight weeks from today, let the above-named petitioner be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount
