The petitioner is seeking anticipatory bail in connection with Chapra Rail Police Station Case No.129 of 2018 registered for offences punishable under sections 448, 147, 149, 341, 323, 307, 354, 379, 302 and 394 of the Indian Penal Code.

The informant was engaging in the repairing of the railway track and after returning from Chapra he reached at Jagdamba gate and began to keep the articles then two accused persons namely Mithilesh Kumar and Vijay Prasad came out from the bush and started snatching the material articles. On protest, they have given a knife blow and other assaulted on the

Patna High Court Cr.Misc. No.78982 of 2018(2) dt.09-01-2019 2/2 stomach and back of Sunil Kumar. The informant and Sunil Kumar were brutally assaulted and badly injured. The statement of Deepak Kumar and Dipu Kumar recorded under section 164 Cr.PC. gives clear picture with regard to involvement of this petitioner in the aforesaid offence. Looking to the facts and circumstances of the case, the prayer for bail of the petitioner is rejected. However, if the petitioner surrenders and prays for regular bail, the court below without being prejudiced by the order of this Court, will take decision in accordance with law, preferably on the same day.
