JUSTICE BIRENDRA KUMAR ORAL ORDER 17-02-2017 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.

The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 353, 427, 171(F) of the Indian Penal Code as well as Section 130 of the Bihar Panchayat Raj Act, 2006. According to FIR, the named accused persons including the petitioners created obstruction in peaceful polling at the polling station. Specific allegation of manhandling to the Election Officer is against other named accused persons.

Patna High Court Cr.Misc. No.4013 of 2017 (2) dt.17-02-2017 2/2 Submission is that the petitioners had gone to cast their votes.

Let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria/Successor Court in connection with Narpatganj Police Station Case No. 113 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
