Petitioner apprehends arrest in Asaon PS Case No. 68 of 2017 registered under Sections 272, 273, 380 of the IPC and Sections 30/30(a) of Bihar Prohibition and Excise Act, 2016.

It is submitted by Counsel for the petitioner that he has been implicated in this case only because the motorcycle, on which the two accused persons from whom recovery of 25.9 litres of foreign liquor is attributed was belonging to the petitioner. The petitioner has no concern with the recovery made from the other two co-accused and he is a man of clean antecedent.

Considering the aforesaid submissions as also the facts and circumstances of the case, prayer for anticipatory bail

Patna High Court Cr.Misc. No.75644 of 2018(2) dt.19-12-2018 2/2 of the petitioner is allowed. In the event of his arrest or surrender before the court below within four weeks from today, let the petitioner above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge 2nd -cum- Special Judge, Excise, Siwan in Asaon PS Case No. 68 of 2017 subject to all conditions as laid down in Section 438(2) of the Criminal Procedure Code.
