JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 03-08-2022 Learned counsel for the petitioner is directed to remove all the defects pointed out by the Stamp Reporter within one month. Heard learned counsel for the petitioner as well as learned APP for the State.
The petitioner apprehends his arrest in connection with Chautarwa P.S. Case No. 151 of 2021, registered for the offences punishable under Sections 147, 149, 435, 341, 323, 307, 337, 338, 353, 188, 269, 270 of the Indian Penal Code.
As per allegation, due to an accident with Bolero vehicle one person became badly injured. The mob of 150 persons in protest created chaos and also pelted stones. one Homeguard Brijesh Kumar sustained injuries. 48 persons are named in the FIR including the petitioner.
Learned counsel for the petitioner has submitted that for
Patna High Court CR. MISC. No.184 of 2022(2) dt.03-08-2022 2/2 the same day occurrence the owner of Bolero vehicle has also lodged Chautarwa P.S. Case No. 152 of 2021 as the mob burnt his Bolero vehicle. The petitioner has been granted anticipatory bail in that case vide Cr. Misc. No. 71824 of 2021. Learned counsel has also submitted that one person was badly injured. The mob assembled there was protesting.
Considering the above-mentioned facts and circumstances also considering that in another case as mentioned above the petitioner has been granted anticipatory bail, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned court of A.C.J.M. 1st, Bagaha, West Champaran in connection with Chautarwa P.S. Case No. 151 of 2021, subject to the conditions as laid down under Section 438(2) Cr.P.C. Office shall ensure that all defects are removed by the petitioner within the stipulated time provided in para-1 hereinabove, failing which the matter shall be brought to the notice of this Court.
