The petitioner apprehends his arrest in Balrampur P.S. Case No.54 of 2019 registered under Sections 307, 379 and other sections of the Indian Penal Code.

The informant named the petitioner and others and alleged that the petitioner and other assaulted the informant with sharp edged weapon on his head causing serious injury. It is alleged that the other accused assaulted the informant with stick causing injury on his left hand.

Learned counsel for the petitioner submits that there is a counter version being Balrampur P.S. Case No.53 of 2019. The informant got two injuries; one is bruise and another is swelling. No injury caused by sharp edged weapon was found on the person of the informant.

No.62603 of 2019(2) dt.17-10-2019 2/2 Having considered the facts and the nature of allegation made against the petitioner and the fact that both sides engaged in mutual assault with each other in which the informant got simple injury, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. VI, Katihar in connection with Balrampur P.S. Case No.54 of 2019, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
