JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 06-07-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State assisted by the learned counsel for the informant.
It has been submitted on behalf of the informant that charge has already been framed and trial has commenced. It has also been submitted that informant along with her father is present in Court and that suggests how attentive the prosecution happens. In the aforesaid background, it is expected at the end of the prosecution that all the material witnesses including the informant must be examined within three months and for that, the learned lower court is directed to expedite the trial and record the evidence of witnesses on day to day basis.
Patna High Court Cr.Misc. No.1965 of 2015 (7) dt.06-07-2015 2/2 Learned counsel for the informant further assures that witnesses will be produced.
That being so, for the present I do not see it a fit case for grant of bail in the background of nature of accusation being sole rapist. The prayer for bail is rejected.
