JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-01-2019 This application, for grant of anticipatory bail, arises out of Complaint Case No. 1959(C)/2017, disclosing offences under Sections 323, 341, 498(A) read with Section 34 of the Indian Penal Code.

Allegation against the petitioner is of subjecting the opposite party, who is his wife, to cruelty and harassment in connection with demand of dowry..

Submission of learned counsel for the petitioners is that a completely obscene allegation has been levelled by the petitioner that he has illicit relation ship with his own cousin sister and due to which, the petitioner has filed a divorce case, which is pending in the family court and he is also paying Rs. 5,000/- to opposite party no. 2(wife).

No.1421 of 2019(2) dt.22-01-2019 2/2 Learned counsel for the State and learned counsel for the complainant opposed the prayer for bail and submitted that he is paying the amount of Rs. 5,000/- to his son and not to the informant. Further submission is that opposite party no. 2, the wife of informant is still ready to live with the petitioner.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned SDJM, Bhagalpur, in connection with Complaint Case No. 1959(C)/2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure as well as subject to the condition that petitioner will continue to pay the Rs. 10,000/- to the complainant till any maintenance case is filed and decided and the petitioner will also cooperate in disposal of maintenance case, if any, filed by the complainant, otherwise the complainant will move for cancellation of his bail bonds.
