JUSTICE SANJAY PRIYA ORAL ORDER 17-02-2017 Heard learned counsel for the petitioner and the State.
The petitioner apprehends his arrest in Rivilganj P.S. Case No. 14 of 2016 instituted for the offence under Sections 341, 323, 324, 307 and 498A/34 of the Indian Penal Code. It has been submitted that occurrence took place on account of land dispute. The simple injury has been found on the person of the informant.
As per complaint petition on the date of occurrence, one co-accused Bharat Mahto assaulted Gita Devi with spade on her forehead. Bharat Mahto gave second blow with spade on her jaw. It is further alleged that petitioner assaulted the informant with Dab on her shoulder and head. The injury report of the
Patna High Court Cr.Misc. No.6138 of 2017 (2) dt.17-02-2017 2/2 informant Urmila Devi has been annexed as Annexure-2, wherein doctor has found one lacerated wound on middle of head, simple in nature, caused by hard blunt substance.
From the complaint itself it appears that there is land dispute between the parties. There is no repetition of blow. In the circumstances, prayer of the petitioner for anticipatory bail is allowed.
In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Rivilganj P.S. Case No. 14 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Saran at Chhapra, subject to the conditions as laid down under Section 438(2) Cr.P.C.
