JUSTICE ARVIND SRIVASTAVA ORAL ORDER 19-05-2017 Learned counsel for the petitioner submits that petitioner no. 1 has been arrested, and as such, he is not pressing this application.

In view of the above, the application stands dismissed as not pressed against petitioner no. 1. Heard learned counsel for the petitioner and learned counsel for the State.

Petitioner apprehends his arrest in connection with Bakhtiyarpur P.S. Case No. 409 of 2016 registered under Sections- 147, 148, 149, 341, 323, 324, 385, 308, 504 and 506 of the Indian Penal Code.

Learned counsel for the petitioner submits that

Patna High Court Cr.Misc. No.14098 of 2017 (3) dt.19-05-2017 2/2 there is case and counter case on account of land dispute between the parties. Both sides sustained injuries. Petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, the petitioner no. 2, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa in connection with Bakhtiyarpur P.S. Case No. 409 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
