JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 11-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Special Case No. 10660 of 2018, arising out of Shahjahanpur P.S. Case No. 96 of 2018 for the offence under Sections 30(a)/38(i)/37(b) of the Bihar Prohibition and Excise Act.

In the instant case 50 litres Mahua liquor was kept in a gunny bag placed below the seat of Tempo.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He submits that the petitioner has no concern with the liquor and the petitioner was accused only because he was travelling in the said Tempo, as a passenger. The petitioner is in custody since 06.11.2018. Considering the totality of the facts situation, the petitioner, named above, is directed to be released on bail on
