2. The petitioner apprehends his arrest in a case registered for the offence under Sections 191(2), 191(3), 109, 103(1), 351(2) and 352 of the Bhartiya Nyaya Sanhita, 2023 and Section 27 of Arms Act.
3. The prosecution case, in brief, is that on 14.03.2025 at about 2:30 PM, when the informant was at his door, all the accused persons named in the F.I.R. including this petitioner armed with weapons came and started abusing and called the informant's son Rohit Kumar and when informant's son came outside from his house, co-accused Amrendra Rai and Alok Yadav caught hiş hands and co-accused Chhotu Yadav assaulted him on his head with iron rod and co-accused Jagarnath Rai inflicted knife blow on his stomach, as a result of which, informant's son died on the spot. It is further alleged that some

4. Learned counsel for the petitioner submits that as per F.I.R. itself, specific accusation of assault is against other co-accused persons. So far as this petitioner is concerned, he is only alleged to be member of the mob and there is absolutely no allegation of assault.
5. Learned A.P.P. for the State has opposed the bail petition.
6. Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari in connection with Kalyanpur P.S. Case No. 93 of 2025, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023.
