Petitioners apprehend their arrest in connection with Nawada (Town) SC/ST P. S. case no. 34/2014.

Originally, informant filed complaint case which was converted into police case.

No doubt, case has been registered for the offences punishable under section 3 (I) (X) of the SC/ST (Prevention of Atrocities ) Act, 1989 as well as other sections of the Indian Penal Code but from perusal of para 6 of the complaint petition, application of provision of SC/ST (Prevention of Atrocities ) Act appears to be doubtful.

The contention on behalf of the petitioners is that the

No.4855 of 2015 (2) dt.05-02-2015 complainant had purchased some articles from the grocery shop of petitioner no.1 on credit and when petitioner no.1 demanded the aforesaid dues, complainant lodged this false case. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that in the event of arrest/ surrender within four weeks from the date of receipt of this order to the concerned court, let the above named petitioners be released on bail on furnishing bail bonds of Rs 10,000/- each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nawada in Nawada (Town) SC/ST P. S. case no. 34/2014 subject to condition as laid down under section 438(2) of the Cr.P.C.
