The petitioners have filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 341, 342, 324, 307, 504 and 506/34 of the Indian Penal Code.

As per F.I.R., the allegation against the petitioners and other co-accused is that they have assaulted the son of the informant namely, Purshottam Kumar Sangahi by means of Barchchi, Hasua, Iron rod and knife due to which he sustained injury.

It is submitted by learned counsel for the petitioner that the petitioners are innocent and have committed no offence. They

Nothing specific allegation has been attributed against the petitioners rather allegation levelled against them is general and omnibus in nature. A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Similarly situated other co-accused namely, Naresh Singh has already been enlarged on bail by this Bench ovide order dated 07.08.2023 passed in Cr. Misc. No. 20638 of 2023. It is also submitted that petitioners are languishing in judicial custody since 01.08.2023. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Bihpur P.S. Case No. 457 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.7th, Naugachia, Bhagalpur.
