JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2019 The petitioners apprehend their arrest in connection with Kishanganj P.S.Case No. 573 of 2018 registered under Sections 307, 323, 341 and 379/34 of the Indian Penal Code. At the very outset, it is submitted that petitioner nos. 1 and 3 have been arrested. In such view of the matter, this application is dismissed as withdrawn with respect to petitioner nos. 1 and 3.
Allegation against rest of the petitioners is of assaulting the informant and snatching of Rs. 10,000/-.
Submission of learned counsel for the petitioners is that there is land dispute between the parties and there is case and
Patna High Court Cr.Misc. No.1487 of 2019(2) dt.23-01-2019 2/2 counter case in between the parties and no specific allegation has been attributed against any of the petitioners. Heard learned APP also.
Having heard both sides and in the facts and circumstances, as stated above, let the petitioner nos. 2,4,5,6 and 7, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the learned CJM, Kishanganj in connection with Kishanganj P.S. Case No. 573 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
