The petitioner apprehends his arrest in connection with Gopalganj Town P.S. Case No. 394 of 2016, registered under Sections 419, 420 and 120-B of the Indian Penal Code and Section 8 and 9 of Bihar Examination Act, pending in the court of the Chief Judicial Magistrate, Gopalganj.

The accusation is that in the examination of Mathematic paper of T.D.C Part-II at Kamla Rai Mahavidyalaya, Gopalganj (Bihar) one Ram Kumar Ram was found sitting in the said examination in place of the petitioner.

Learned counsel for the petitioner submits that, in fact, due to unavoidable circumstances the petitioner could not reached at the examination centre to appear in the said

Patna High Court Cr.Misc. No.16232 of 2017 (4) dt.29-08-2017 2/2 examination as such petitioner has no concern with the person who was apprehended in the examination sitting in his palace. Having considered the facts and circumstances of the case and the nature of allegation against the petitioner, I am not inclined to grant anticipatory bail to the petitioner.
