2. The petitioner has prayed for regular bail in a case registered for the offence punishable under sections 364A of the Indian Penal Code.

3. As per prosecution case, the informant alleged that on 24.6.2023, his son was playing at his door but after sometime, he became traceless. From CCTV footage, it is found that the petitioner abducted the informant's minor son.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case on the basis of CCTV footage. The victim was not recovered from conscious

No.63457 of 2023(3) dt.29-11-2023 2/2 possession of the petitioner rather at his instance, the victim was recovered from house of co-accused Rohit Singh who was already enlarged on bail granted by learned court below. The petitioner has got no criminal antecedent as stated in para-3 of the bail petition and languishing in judicial custody since 25.6.2023.

5. Learned APP appearing for the state and learned counsel for the informant have vehemently opposed the prayer of regular bail and submitted that the at the instance of this petitioner, victim was recovered.

6. Considering the facts and circumstances of the case as well as custody of the petitioner, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Majhi P.S. Case No. 203 of 2023 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Saran at Chhapra.
