====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 16-01-2019 Heard learned counsel for the petitioner and the State.

The petitioner seeks bail in Bihpur (Jhandapur) P.S. Case No. 08 of 2017, instituted for the offence under Sections 302, 201/34 of the Indian Penal Code and Section 27 of the Arms Act.

Counsel for the petitioner submits that petitioner is not named in the written report. The name of petitioner has come on the basis of statement of hear-say witnesses. Counsel for the petitioner further submits that other co-accused namely Dharo Singh and Gujo Paswan @ Gunjan Paswan @ Chandan Kumar Paswan have already been granted bail vide order dated 28.2.2018 and 68946 of 2018 passed by coordinate Bench as well as this Court in Cr. Misc. 11498 of 2018 and 68946 of

Patna High Court Cr.Misc. No.79090 of 2018(2) dt.16-01-2019 2/2 2018 respectively.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional District & Sessions Judge, Naugachia, Distt. Bhagalpur, in connection with Bihpur (Jhandapur) P.S. Case No. 08 of 2017, subject to the condition that both the bailors will be the close relatives of the petitioner.
