The petitioner apprehends his arrest in Karjarin P.S. Case No. 22/2016, registered for the offences punishable under Sections 406, 420 and other sections of the Indian Penal Code. The informant alleged that the petitioner came to his office and stealthily torn two cheques from his pass-book and fraudulently withdrew Rs. 3,00,000/- from his account. Learned counsel for the petitioner submits that from perusal of annexure - 2 and annexure - 3 it would appear that there is agreement between the informant and father of the petitioner. Money was lying due against the informant. The informant gave cheques to the petitioner which was credited in the account of the petitioner. The petitioner did not commit any fraud.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, Birpur, Supaul in connection with Karjarin P.S. Case No. 22/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
