The petitioners are apprehending their arrest in connection with Banka (Barahat) P.S.Case No.142 of 2019 registered for offences punishable under Sections 147, 148, 149, 323, 325, 307, 354(D), 354, 379, 504, 506 of the Indian Penal Code and Section 8 of the POCSO Act.

Allegation against the petitioners is that they tried to outrage the modesty of the informant and when brother of the informant went to make complaints about the same, he was assaulted also and also golden chain and cash was snatched

Submission of the learned counsel for the petitioners is that they have falsely been implicated in this case and there is no specific allegation against them.

Heard learned A.P.P., who has opposed the prayer for bail. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant privilege of anticipatory bail to the petitioners, however, the petitioners are directed to surrender before the learned court below within a period of six weeks from the date of receipt of the order and make prayer for regular bail, which will be considered by the learned court below without being prejudiced by the order of this Court.

With the aforesaid direction, this application is dismissed.
