The petitioner prays for grant of regular bail in a case registered for the offence punishable under section 302 and other ancillary sections of the Indian Penal Code and section 27 of the Arms Act.

As per the prosecution case, two persons riding on the motorcycle came to the shop of the informant and one of them fired as a result of which father of the informant sustained gun shot injury and died during treatment. Informant has suspected that this petitioner who was earlier working in his shop conspired and committed murder of his father. Learned counsel for the petitioner submits that the

Though the petitioner has been named in the FIR but he has not been identified in the CCTV footage of the shop and at best he is alleged to be conspirator and not the assailant. Petitioner has claimed clean antecedent and he is in custody since 1.8.2020. Investigation is complete. Learned counsel appearing for the State as well as the informant oppose the prayer for bail.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Benipatti Madhubani in Bisfi Police Station Case No. 183 of 2021.
