The petitioner seeks bail in connection with Khajauli. P.S. Case No. 127 of 2018 registered under Sections 147, 148, 149, 341, 323, 324, 307 and 506 of the Indian Penal Code. Six motorcycle borne criminals are said to have assaulted the informant. Out of them two criminals were identified by the informant in the light of the motorcycle during the course of occurrence.
It is submitted by the learned counsel for the petitioner that neither the petitioner is named in the F.I.R. nor was apprehended on spot. He was not put on TIP. Petitioner has been falsely implicated in this case on the basis of confessional
Patna High Court Cr.Misc. No.79987 of 2018(2) dt.18-01-2019 2/2 statement of co-accused, namely, Rudra Kumar Ram which has no evidentiary value in the eye of law. Informant has sustained four injuries but all are simple in nature. Allegation levelled against the petitioner is general and omnibus in nature. He has no criminal antecedent. Petitioner has been languishing in custody since 23.07.2018. Co-accused, namely, Rudra Kumar Ram has been enlarged on bail by a co-ordinate Bench of this Court vide order dated 10.01.2018 passed in Cri. Misc. No. 62173 of 2018.
On the other hand learned APP opposed the bail prayer of the petitioner.
In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, 3rd, Madhubani in connection with Khajauli P.S. Case No. 127 of 2018, CRI No. 1490/2018.
