2. The present petition has been preferred for the following relief/s:

(i) for issuance of an appropriate writ (s), order (s), or direction(s) to the respondents to remove the illegal and unauthorized construction over the purchased (Raiyati) lands of the petitioner since the respondents

Patna High Court CWJC No.14187 of 2025(2) dt.08-09-2025 2/3 have constructed the drainage with road at Khata No. 13 Khesra No. 874, Mauza Chak Khara Area 10 dhur bearing its Jamabandi No. 16 of the revenue records situated under Mohalla New Kathalbari Darbhanga near Haro English School since without following the mandate of law as well as without giving any opportunity of hearing and further to direct the respondents to pay the damages/compensation to the petitioner for mental agony and civic disturbances.

3. At the outset, learned counsel for the petitioner submits that the petitioner has already approached before the Collector, Darbhanga on 25.07.2025 and endorsement is there.

4. Both the learned counsels representing the Collector, Darbhanga as also the Municipal Commissioner, Municipal Corporation, Darbhanga jointly submit that the matter shall be taken to its logical conclusion.

5. The record shows that on the same day, the petitioner preferred petition before the Municipal Corporation, Darbhanga. However, it would be appropriate that the Collector, Darbhanga looks into the matter where the parties including

Patna High Court CWJC No.14187 of 2025(2) dt.08-09-2025 3/3 Dharbanga Municipal Corporation shall be filing their respective replies and after hearing them, the matter is to be taken to its logical conclusion by a reasoned order.

6. Any development that takes place in between shall be subject to the final outcome passed by the Collector, Darbhanga by 31.03.2026.

7. The writ petition is disposed of with the aforesaid observation.
