Petitioner is accused in connection with Rail Begusarai P.S. Case No. 41 of 2018 registered under Section 30 (a) of the Bihar Prohibition and Excise Act, 2016. The allegation is regarding recovery of 26 bottle of 750 ml. and 113 bottle of 180 ml. each of illicit foreign liquor from possession of the petitioner.

Submission of learned counsel for the petitioner is that petitioner is innocent and has falsely been implicated in the present case. It is further submitted that the said recovery war made in platform no. 2, where the petitioner was waiting for train for going to Saharsa and he was arrested by police only on

Patna High Court Cr.Misc. No.1070 of 2019(2) dt.25-01-2019 2/2 suspicion. The petitioner is having clean antecedent and he is languishing in custody since 05.11.2018.

Having considered the facts and circumstances of the case, let the above named petitioner be released on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II- cum- Special Judge, Excise Act, Begusarai, in connection with Rail Begusarai P.S.
