The petitioners apprehend their arrest in Mohiuddinagar P.S. Case No. 167 of 2016 instituted for the offence under Sections 448, 341, 323, 324, 354 and 379/34 of the Indian Penal Code.

It has been submitted that there is general and omnibus allegation against these petitioners. The injury of informant's son has been found to be simple in nature which is annexed as Annexure-2. The case has been compromised between the parties.

From the written report, it appears that there is

Patna High Court Cr.Misc. No.7435 of 2017 (2) dt.23-02-2017 2/2 general and omnibus allegation against all the petitioners. The injury report shows that son of the informant sustained simple injury on his person. The learned Sessions Judge, Samastipur has also mentioned in the impugned order about the injury no.3 which is swelling on neck lateral side and doctor has opined the aforesaid injury might have created danger to life. It is mentioned in para-3 of bail petition that petitioners have clean antecedent. In the circumstances, prayer of the petitioners for anticipatory bail is allowed.

In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Mohiuddinagar P.S. Case No. 167 of 2016, they shall be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-IV, Samastipur, subject to the conditions as laid down under Section 438(2) Cr.P.C.
