The petitioner is apprehending his arrest in a case registered for the offence punishable under Sections 379 & 420 of the Indian Penal Code pending in the learned court below. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this case. He further submits that petitioner is not named in the FIR but his name has been surfaced on the basis of information given by spy of police as mentioned in Para-21 of the case diary. He submits that there is no specific overt act against the petitioner. He further submits that petitioner have got five criminal antecedents as stated in para-3 of the bail application. Per contra, learned APP for the State vehemently

Patna High Court CR. MISC. No.61638 of 2022(2) dt.10-01-2023 2/2 opposing the bail application and submitted that the tower location of mobile of petitioner was found near the place of occurrence at the time of occurrence. Hence, he does not deserve anticipatory bail.

Considering the facts and circumstances of the case, I am not inclined to enlarge the petitioner on bail in connection with Pusa P.S. Case No. 75/2020. Accordingly, his prayer for anticipatory bail is hereby rejected.
