JUSTICE SHAILENDRA SINGH ORAL ORDER 18-09-2025 The instant writ application has been filed by the petitioner under Article 226 of the Constitution of India seeking the following reliefs:- " (i) For issuance of an appropriate writ directing the respondents for measurement and demarcation of land of the petitioner appertaining to New Khata No.86 New Khesha No.425 Area 2 Katha 9 dhurs under Mauja Bargaon Thana No.230 P.S.- Kusheshwar Sthan Circle Kusheshwar Sthan District

Patna High Court CWJC No.14752 of 2025(2) dt.18-09-2025 2/3 Darbhanga after setting aside the order dated 22.5.2025 passed by the Deputy Collector Land Reforms Biraul District-Darbhanga in BLDRA 37/2024-25 directing the petitioner to invoke the Jurisdiction of the competent court.

(ii) For any other reliefs/ directions(s) order(s) to which the petitioner may be found entitled in the facts and circumstances of the case."

2. Heard Mr. Amarnath Jha, learned counsel appearing for the petitioner and Mr. Ajit Anand, learned AC to GP-13 for the State-Respondents.

The main grievances raised by the petitioner are that the measurement and demarcation of his land have not been done despite an application in this regard having been filed by the petitioner in the year 2023, i.e., Annexure P/2 and secondly, the order dated 22.05.2025 passed by the Deputy Collector Land Reforms, Biraul, Darbhanga is without jurisdiction and does not relate to the main issue raised by the petitioner.

After having gone through the averments made in this petition and having heard the petitioner's counsel and the State-Respondent's counsel, this Court finds that the petitioner has efficacious alternative remedies to redress his grievances. Further, in the order dated 22.05.2025 passed by the DCLR, Biraul, Darbhanga, the petitioner has been granted liberty to

Patna High Court CWJC No.14752 of 2025(2) dt.18-09-2025 3/3 approach the competent authority/forum for redressal of his grievances. This Court is not persuaded to invoke its writ jurisdiction for redressing the petitioner's issues.

5. Accordingly, the instant writ petition stands disposed of, reiterating the liberty granted by the DCLR, Biraul, Darbhanga, in the order dated 22.05.2025. If the petitioner avails the said liberty within the next four weeks from today then the period spent by the petitioner in this writ petition shall be excluded while computing the necessary limitation period.

6. The petitioner will have the liberty to have the land in question measured in accordance with the provisions of the Tenancy Rules of Bihar Tenancy Act upon payment of the requisite fee and compliance with the necessary requirements. (Shailendra Singh, J) maynaz/- U
