The petitioner has preferred this application for grant of regular bail in a case registered under sections 379 and 411 of the Indian Penal Code.

As per the prosecution case, the seat of the tempo belonging to the informant which was parked was found stolen. Further 16 bags of salt was also stolen. It is further stated that subsequently the seat was found in the tempo belonging to the petitioner and one Mahesh Kumar.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case under some misunderstanding. The petitioner is in custody since 23.9.2021 and investigation in the case has concluded.

Having heard learned counsel for the parties and taking into consideration the nature of allegation together with the petitioner having remained in custody for 8 months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Khizersari P.S. Case no. 264 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M-IV, Gaya. (Partha Sarthy, J) Prakash/- U
