Petitioner is apprehending his arrest in connection with Barhara P.S.Case No.164 of 2018 , registered for offences punishable under Sections 143, 152, 186, 341, 323, 353, 427 of the Indian Penal Code and Section 3 of the Prevention of Damage to Public Property Act.
As per FIR, 100 persons were closing the shop when the police party reach there and they have attacked the police. Petitioner is not named in the FIR and later on his name transpired. He has no criminal antecedent. He is accused in one more case .
Submission of the learned counsel for the petitioner is that that for the same occurrence another case has been filed
Patna High Court CR. MISC. No.72074 of 2019(3) dt.26-11-2019 2/2 and except that he is not accused in any other case.. Heard learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, in the event of arrest or surrender before the learned court below within a period of three weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned CJM, Purnea in connection with Barhara P.S.Case No.164 of 2018 subject to conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
