2. The petitioner is in custody in connection with Ghorahasan (Lakhaura) P.S. Case No. 45 of 2021 for the offence under Sections 341, 323, 302, 379, 448, 34 of the Indian Penal Code.

3. As per prosecution, the accused persons have assaulted the deceased.

4. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 14.07.2023. He further submits that during investigation wife of the deceased has said it was the Vishal Singh @ Ujjwal Singh who had assaulted the deceased.

5. There is specific allegation of assaulting the deceased on Vishal Singh @ Ujjwal Singh.

6. Considering the aforesaid facts and period of custody, the petitioner, named above, is directed to be released on bail after framing of charge on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M-III, Sikrahna (Dhaka), East Champaran in connection with Ghorahasan (Lakhaura) P.S. Case No. 45 of 2021.

7. It is also subject to the condition that the petitioner would cooperate in the proceeding of the court below. In the event of failure to appear on two consecutive dates, the court below will be at liberty to pass appropriate order including cancellation of bail bonds of the petitioner.
