Petitioner is languishing in custody since 21.12.2015 in a case registered for the offences punishable under Section 20(B) (1), 22(A) of the Narcotics Drugs and Psychotropic Substances Act.

The prosecution case is that about 5 K.g ganja was recovered while the petitioner was travelling on motorcycle.

It is submitted by the learned counsel for the petitioner that recovery has not been made from the possession of the petitioner. Statement has been made in para-3 of the petition that petitioner has no criminal antecedent. The investigation has already concluded. Considering the recovery of contraband between

No.13617 of 2016 (3) dt.21-04-2016 small and commercial quantity, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge-cum-Special Judge, N.D.P.S.

Act in connection with Supaul P.S. Case No. 566 of 2015. The learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence if he defaults for three consecutive occasions.
