JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-09-2019 This application, for grant of anticipatory bail, arises out of Kuchaikote P.S. Case No. 219 of 2019, disclosing offences under Sections 406, 409, 420, 120(B) of the Indian Penal Code and Section 7 of the E.C. Act.
As per F.I.R. during inspection of the P.D.S shops and petitioner happens to be Chairman of the PACS. Submission of learned counsel for the petitioner is that as per resolution of the PCAS, shop was handed over to some other person and furthermore, she is lady and is ready t abide by any condition imposed on her.
Heard learned A.P.P. also.
Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of her arrest or surrender before the court below within
Patna High Court CR. MISC. No.58967 of 2019(3) dt.24-09-2019 2/2 six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Gopalganj, in connection with Kuchaikote P.S. Case No. 219 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. It is made clear that petitioner will cooperate in the investigation and make herself available as and when required by the Investigating Officer/ authorities concerned.
