This is a case registered under Sections 366A and 34 of the Indian Penal Code It is submitted by petitioners counsel that the petitioners have falsely been implicated in this case because they are mother and father of one Sonu Kumar with whom the informant's daughter has eloped. This fact is obvious from the statement of the alleged victim of kidnapping made under Section 100 Cr.P.C. (Annexure-2). He also submits that the petitioners have no criminal antecedent and they are in custody since 06.10.2018.
In the facts and circumstances of the case, prayer for bail of the petitioners is allowed. Let the petitioners above
Patna High Court Cr.Misc. No.75970 of 2018(2) dt.17-12-2018 2/2 named be released on bail on their furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate - I, Saran at Chapra in Sonepur @ Sonpur P.S. Case No. 872 of 2018 subject to the conditions :
(i) That one of the bailors will be a close relative of the Petitioners who will give an affidavit giving genealogy as to how he is related with the Petitioners. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioners.
(ii) That the Petitioners will be well represented on each date and if they fail to do so on two consecutive dates, their bail will be liable to be cancelled.
