This application, for grant of anticipatory bail, arises out of Mojahidpur (Babarganj) P.S. Case No. 53 of 2014, disclosing offences under Sections 307/34 of the Indian Penal Code and Sections 3/4 of the Explosive Substance Act. The First Information Report was lodged against unknown. Petitioner's name surfaced in course of investigation. Allegedly, unidentified miscreants hurled a bomb in front of the informant's house, leading to minor injuries to the daughter of the informant.

Learned counsel for the petitioner has submitted that in course of investigation, the informant took the petitioner's name. He submits that the petitioner was known to the informant

Patna High Court Cr.Misc. No.23109 of 2016 (4) dt.19-07-2016 2/2 from before as the petitioner was a co-villager of the informant and, as such, the informant could have disclosed the petitioner's name in the very beginning at the time of lodging of the First Information Report. The petitioner has no criminal antecedent, as stated in paragraph 3 of the application.

Considering the above, this application is allowed. Let the petitioner, above-named, in the event of his arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.10,000/- (Rupess Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhagalpur in connection with Mojahidpur (Babarganj) P.S. Case No. 53 of 2014, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
