JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-04-2017 The petitioner is apprehending his arrest in connection with Barauli P.S. Case No. 17 of 2017, registered for the offences punishable under Sections 272, 273, 420 of the Indian Penal Code and Section 30(a)(b)(c) of Bihar Prohibition and Excise Act 2016. It has been submitted on behalf of the petitioner that she is a lady and she has no concern with the recovery of the liquor and she has herself produced the driver before the police. Heard learned A.P.P. who has opposed the prayer for bail.

Having heard both sides, and in view of Section 76(2) of the Bihar Prohibition & Excise Act, 2016, I am not inclined to enlarge the petitioner on bail.

Hence, the prayer for anticipatory bail of the petitioner is

Patna High Court Cr.Misc. No.17757 of 2017 (2) dt.26-04-2017 2/2 hereby rejected.

Let the petitioner surrender before the court below within a period of four weeks and make prayer for regular bail, which would be considered on its own merit, without being prejudiced by anything said in this order preferably on the same day.
