The prayer for bail of the petitioner was earlier rejected and as the petitioner has been in custody since 03.06.2017, the petitioner has sought to renew his prayer for bail on the ground that the trial has not concluded till date. A report was called from the Court of Presiding Officer, Fast Track Court-II, Khagaria, who has reported that 7 witnesses have already been examined and 2 are yet to be examined out of which one is a private person and another is a doctor. It is further submitted in the report that the trial will conclude within 3 months.

However, considering the period of custody, it is directed that the Court of the Presiding Officer, Fast Track

Patna High Court CR. MISC. No.74104 of 2019(3) dt.05-02-2020 2/2 Court-II, Khagaria, shall proceed to hear the case and conclude the trial positively on or before the 30th of March, 2020. It is made clear that no unnecessary adjournments should be granted either to the prosecution or to the defence. The prayer for bail is rejected.
