JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-03-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 341, 323, 447, 307, 504 and 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

No doubt, the occurrence took place on account of land dispute but first information report reflects that this petitioner opened fire hitting on abdomen of the informant, who subsequently died, in course of his treatment, therefore, considering the aforesaid facts and circumstances as well as submissions of the parties, I am not inclined to release the petitioner, above named, on bail in connection with Udwant

Patna High Court CR. MISC. No.1534 of 2019(4) dt.15-03-2019 2/2 Nagar P.S. Case No. 197 of 2017, pending in the court of learned Chief Judicial Magistrate, Bhojpur, Ara, hence, his prayer for bail stands rejected.
