The petitioner seeks bail in connection with Obra P.S. Case No. 216 of 2018 instituted for the offence under Section(s) 302 of the Indian Penal Code and Section 27 of the Arms Act. Learned counsel for the petitioner submits that FIR is against unknown. The informant has alleged that he got information on 29.09.2018 at 5 am that his father has been shot dead. The informant went to the place of occurrence and found his father lying dead.

Learned counsel for the petitioners submits that during investigation police recorded confessional statement of one of the co-accused, namely, Sanjay Yadav and thereafter police recorded the confessional statement of this petitioner. The

No.1909 of 2019(2) dt.15-01-2019 2/2 learned Sessions Judge, Aurangabad has mentioned in the impugned order that Sanjay Yadav had taken the name of this petitioner which would appear from para 21 of the case diary. Thereafter, police recorded confessional statement of this petitioner which is mentioned in para 31 of the case diary. Petitioner is in custody since 07.10.2018.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Daudnagar, Aurangabad in connection with Obra P.S.
