2. The petitioner has preferred this application for grant of regular bail in connection with Maner P.S. Case No. 504 of 2022 dated 19.07.2022 registered for the offences punishable u/s 30(a) of the Bihar Prohibition and Excise Act.

3. As per the prosecution case, total 80 litres of illicit country made liquor was recovered from the house of the petitioner.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner is in custody since 21.12.2023 when he was arrested in P.S. Case No. 671 of 2022. Simultaneously, he was remanded judicial custody in above mentioned case and is in

Patna High Court CR. MISC. No.69244 of 2024(2) dt.25-09-2024 2/2 custody till date. In the present case, the petitioner is in custody since 11.07.2024. The name of the petitioner has transpired in this case merely on suspicion. Nothing has been recovered from the conscious possession of the petitioner. The petitioner has no concern with the alleged recovery. The petitioner has eleven criminal antecedents as stated in para 3 of the bail petition.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Danapur, Patna in connection with Maner P.S. Case No. 504 of 2022, with the condition:- (i) That the petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.
