Mr.Bishweshwar Ram ====================================================== CORAM: HONOURABLE MR. JUSTICE MOHIT KUMAR SHAH ORAL ORDER 16-11-2019 Heard the learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Harnaut P.S. Case No. 149 of 2019 for the offences registered under Section 392 of the Indian Penal Code. The allegation in the present case according to the informant is that he is the Field Officer of Bandhan Bank, Harnaut Branch and while he was coming, after making collection, three unknown persons had surrounded his motorcycle and snatched a sum of Rs. 20,800/- as well as some other documents and Bank Pass Machine etc. and then the said accused persons had fled away.

The learned counsel for the petitioner submits that since the motorcycle in question was recovered from the in-laws

Case No. 151 of 2019 was registered under Section 414 of the Indian Penal Code and Sections 25(1-B)a, 26 and 35 of the Arms Act and the petitioner has already been granted anticipatory bail in the said case vide order dated 09.09.2019, passed in Criminal Misc. No. 57074 of 2019. It is further submitted that the name of the petitioner has transpired in the present case on account of the confessional statement made by the co-accused person, namely, Mithun Rai who was arrested in connection with the aforesaid Harnaut P.S. Case No. 151 of 2019. It is further submitted that no recovery of the snatched cash/articles/documents have been made from the house of the petitioner.

Lastly, it is submitted that the petitioner is a good student and has been selected for Railway Services, hence there is remote possibility of him committing such crime. The petitioner is stated to be having a fair antecedent apart from the aforesaid Harnaut P.S. Case No. 151 of 2019 in which the petitioner has already been granted anticipatory bail.

Patna High Court CR. MISC. No.57543 of 2019(3) dt.16-11-2019 3/3 furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Nalanda at Bihar Sharif in connection with Harnaut P.S. Case No. 149 of 2019 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. It is needless to state that the petitioner would cooperate with the investigation and would also appear on each and every date so fixed by the learned court below and in the event of his failure to appear before the court below on two consecutive dates, so fixed, the present order would be rendered null and void and the petitioner would be taken into custody forthwith.
