The petitioner is languishing in custody for the offences punishable under Sections 376/341/323/ 324/ 504 / 506/34 of the Indian Penal Code and Section 4 & 8 of POCSO Act and Section 3(2)(v) of the SC/ST Act.

The allegation of commission of rape against minor is against co-accused Ajit Kumar when the prosecution side went to complain about the act of Ajit Kumar the petitioner and others, who are family members, allegedly abused and threatened to kill. The impugned order has been passed by the learned Special Judge, POCSO, Patna.

Petitioner is in custody since 18.06.2019.

Patna High Court CR. MISC. No.59738 of 2019(3) dt.28-11-2019 2/2 Investigation of the case is already complete. The victim girl in her statement under Section 164 Cr.P.C. has also levelled allegation against Ajit Kumar.

Considering the nature of allegation against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Bypass P.S. Case No.158 of 2019, with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
